Indian Penal Code 1860 - Section 363, 366 - Bharatiya Nyaya Sanhita 2023 - Section 137(2), 87 -Accused convicted for the offences punishable under Sections 363 and 366 of the IPC - Allowing appeal, SC observed: Even if the finding that prosecutrix was between 16 to 18 years of age is to be accepted, the offence under Sections 363 and 366 IPC would still not be made out as she was very much in the age of understanding as to what was right and wrong for her- From the evidence of the prosecutrix itself, it will be clear that she had voluntarily gone along with the appellant herein, travelled to various places and also resided as husband and wife.
