Code of Civil Procedure 1908 - Order XII Rule 6- The Court can pass a judgment at any stage of the suit and that too on its own motion i.e. without any application being filed by any party - Rule 6 authorises the Court to not only pass a decree regarding admitted claim, but also to dismiss the suit. Hindu Law - Succession -Members of a branch, or of a sub-branch, can form a distinct and separate corporate unit within the larger corporate family and hold property as such. Such property will be joint family property of the members of the branch inter se, but will be separate property of that branch in relation to the larger family
