Indian Penal Code 1860 - Section 149 - While convicting a person charged with Section 149 IPC, which creates a vicarious liability, the Courts will have to be extra cautions- Though the provisions governing falsus in uno, falsus in omnibus may not have a strict application to the Courts in India, the evidence will have to be assessed with a higher degree of care, especially when a witness deposes differently and the Courts find that a part of the statement is not correct. This is more so when we are dealing with a case involving Section 149 of the IPC.
